Beyond Shelter: Mapping the Dependency Court Timeline
A shelter hearing is the starting line, not the finish. The dependency process that follows has defined milestones — and families who know the map can prepare for each one instead of being ambushed by it.
Arraignment hearing (28 days post-shelter)
The formal reading of the state's Dependency Petition. Parents enter a response to the allegations:
- Admit — accept the allegations as stated
- Deny — contest them; the court sets an Adjudicatory Hearing (a trial)
- Consent — accept the court's jurisdiction without admitting the specific allegations
Which response is right is a legal-strategy decision — make it with counsel (see your right to appointed counsel), not under hallway pressure.
Case plan development & acceptance
DCF creates a structured Case Plan detailing required tasks — parenting classes, mental health evaluations, drug screenings, housing stability. Advocates and parents must review these tasks to ensure they are tailored and achievable, not generic or punitive.
Judicial Review (JR) hearings
Held at least every six months — or more frequently if requested. The court reviews:
- Compliance with the Case Plan
- Child safety in the current placement
- Educational stability (see preserving education in crisis)
- Whether placement changes are warranted — such as transitioning from a group home to short-term residential or home
JR hearings are where a well-kept incident log and binder pay off — the court can only weigh what is documented and presented.
Status hearings
Brief, targeted court check-ins requested by attorneys — such as an Attorney ad Litem or parent counsel — to resolve specific breakdowns: improper facility care, delayed medical treatment, or uncooperative case managers. You do not have to wait six months for the next JR when something is actively going wrong; this is the tool your parallel legal strategy escalates into.
